An agreement of the Arts Commission is the document by which a client hires an artist to create a specific work of art for him. It may be a painting, a film, a sculpture or other work of art desired by the client. These agreements are simple documents between a client and an artist. The client is the party that commands the artwork; In other words, they are the party that engages the artist. The artist, of course, is the party that creates art. A Commission contract sets out the conditions of an artist who creates a commissioned work. Commission contracts generally indicate project dates, payment schedules, significant project requirements or restrictions, and establish registration points between the artist and the curator. It is quite reasonable for you, the artist, to collect 25% to 50% of the full cost of the artwork in advance before you start working. This serves to protect your investment in materials and time. You should list the total cost of the work, the down payment needed to start with the commission and when the final payment is due. The final payment may be due upon delivery of the work, or it may be due after final approval by the customer.
Be careful, because if you indicate that the final payment is due after the client has authorized work, you will find that you are working again and again until the customer is satisfied. You can consult a standard contract for an art commission here, here or here. I sought the agreement of the Artists Committee to find only these few examples – there are many more to see online. A timeline, including the times scheduled for recording the art in the works, will ensure that you and your curator are on the same page. Depending on the size of the Commission, there may be several recording moments. While the person or party that paid for you to create may be familiar with your work, they have a vision in mind of how it will end. Make sure all parties feel good about the commission process. A termination contract that determines how the contract between the artist and the curator and the terms of payment/material costs could be terminated if this is the case. The timelines, recordings and details defined throughout the commission process not only allow for a completed project, but also pave the way for future orders. Here is my basic commission contract, it has all the items I need for me, and I can adapt it to any customer.
